News/Media Alliance Joins Comments Urging the Administration to Oppose TDM Exceptions Internationally

On March 11, the News/Media Alliance joined comments to the Office of the United States Trade Representative (USTR) in response to the request for comments regarding unfair trade practices by other countries. The comments were filed by the Digital Creators Coalition, a coalition of almost 50 trade organizations and industry stakeholders. Noting the rapid development and deployment of generative artificial intelligence, the comments noted that the review comes at a critical time for “defending the contributions of American workers and businesses in the creative sector to US economic growth, job creation, and trade surplus.” The comments focused on adopted and proposed copyright exceptions for text and data mining (TDM) in various foreign markets, including Brazil, Chile, China, Colombia, the European Union, Hong Kong, Indonesia, Japan, Singapore, and the United Kingdom. These exceptions facilitate the scraping and use of copyrighted works of America’s creators without authorization or compensation. DCC strongly encouraged the Government “to defend American workers and businesses in the US creative sector against IP theft in other countries” and to engage actively with international counterparts to protect copyright.
