On October 27, the News/Media Alliance filed comments with the Office of Science and Technology Policy (OSTP) in response to its Request for Information on Regulatory Reform on Artificial Intelligence. The OSTP had requested stakeholder comments on existing Federal statutes, regulations, agency rules, guidance, forms, and administrative processes that unnecessarily hinder the development, deployment, and adoption of AI technologies. The comments highlighted the Alliance’s agreement with President Trump’s stated goal of having smart rules to govern AI development, and noted that OSTP has the opportunity to enhance the adoption and innovation in AI by reducing obstacles to cooperation between AI developers and the creative industries. The comments emphasized that robust intellectual property supercharges AI innovation and development, with America leading the world in both AI and the creative industries. Working together, the two can increase global markets, and advance the progress of arts and science, while also protecting our national security interests. The comments further noted that marketplace licensing and collaboration as well as transparency requirements can facilitate AI development, adoption, and competition. Noting that the various text and data mining exceptions adopted around the world have not worked, the comments stated that the uncertainty created by copyright exceptions can further hinder AI, while insufficient competition law enforcement can hurt publishers and Little Tech alike as well as limit consumer choice.
