News/Media Alliance And New Jersey Press Association Submit Comment On Proposed Rulemaking On New Jersey Data Privacy Regulations

On August 28, 2025, the News/Media Alliance and New Jersey Press Association submitted a comment to the New Jersey Division of Consumer Affairs expressing concern that certain provisions of the Division’s proposed rulemaking far exceed the scope of the underlying New Jersey Data Privacy Act.

The comments note that certain provisions of the proposed rules impose burdensome and unproven compliance obligations, undermine standard newsgathering practices and would undermine the constitutionally protected freedom of the press.

The comments argue that the Division is constrained from exceeding the definitions set forth in the relevant legislation, and that the Division should not contradict legislative intent, nor should it contradict the emerging standards already established by other state privacy laws.

N/MA and NJPA urge the Division to reject provisions that would interfere with a free and fair press for New Jersey.
