Court Halts SEC Greenhouse Gas Reporting and Disclosure Rule

The Securities and Exchange Commission’s (SEC) Climate-related Disclosure Rules, which were adopted on March 6 by a vote of 3-2, are temporarily stayed due to numerous lawsuits. A panel of Fifth Circuit Court of Appeals judges issued an order that pauses the rule as the litigation plays out. Challengers had a 10-day window, which ended March 16, after the SEC released the rules to file petitions asking courts to review them under federal rules for multi-circuit litigation. At least nine lawsuits have been filed across six federal courts and the cases are expected to land as soon as this week in one, randomly selected court. The Alliance submitted comments on the proposed rule on June 17, 2022.
